Gun Laws > Prohibited firearms No person may possess, obtain,receive, sell, or use a short-barreled rifle or shotgun, or purchase, sell, have, or possess a machine gun or fully automatic rifle, unless the person is within one of the limited exceptions. |
Gun Laws > Prohibited persons law prohibits ownership, possession, or control of a firearm for a period of 10 years by a person who has been convicted anywhere of a felony involving violence or intimidation, or for a period of 5 years by a person convicted of any other felony or a misdemeanor involving violence or intimidation committed while using a firearm or dangerous weapon. A person who was diagnosed and confined or committed to a hospital or institution in North Dakota or elsewhere as mentally ill or mentally deficient is prohibited from purchasing, possessing, or controlling a firearm except when the person has not suffered from the disability for the previous three years. It is illegal for a handgun or other firearm to be transferred if the transferor knows or has reasonable cause to believe that the transferee is a prohibited person. A handgun cannot be possessed by or transferred to a person under the age of 18, except in limited circumstances. |
