The College denied the student's readmission after the Dean spoke to one of the health care providers and believed that he did not receive adequate assurance that the student would not be disruptive.
In finding that the College violated Section 504 and the Americans with Disabilities Act, OCR emphasized that the College had no objective evidence that the student posed a health or safety risk to the college, justifying a denial of readmission.
However, once the College received assurances from the student's health care providers that her condition had stabilized and that she could reenter school, the College could not require additional assurances from the student's health care providers.
