We agree with Haarhuis that the question appears to be one of first impression; however, we ultimately agree with the Reorganizers (and the district and bankruptcy courts) that jurisdiction under § 304 does not require the presence of assets within the United States.
Haarhuis filed an opposition to Kunnan's motion and a motion for leave to amend (to attempt to fix the jurisdictional problems alleged by Kunnan in its motions).
Haarhuis contends that the reason for this is that a bankruptcy court has no jurisdiction unless there are assets upon which it has authority to act.
