A loophole allows an individual or group to use some gap in the restrictions or requirements of the law or contract for personal advantage without technically breaking the law or contract.

In order to close a loophole, DEP has issued a revised stormwater rule that grandfathers and allows developments having preliminary local approval AND one of four state land use permits to be EXEMPT from the stormwater rules.
I urge you to make the language changes necessary to the proposed regulations to ensure that development projects which do not have all final approvals and permits in hand cannot in any way be grandfathered and/or exempted from the necessary requirements of the new proposed stormwater regulations.
Environmentalists said they were glad the DEP was closing the loophole, but irked at the delay and wary that the new grandfathering clause would also be too broad.
