IRC §415 provides limits on the amount of benefits payable annually to a participant under a defined benefit plan and the amount permitted to be contributed annually to a participant's defined contribution plan account.
Because the IRC §415 defined benefit dollar limit is adjusted for age, the older the participant, the more likely it is that his or her benefit will be reduced due to the application of IRC §401(a)(17).
However, since the current IRC §415 rules that have applied for many years will continue to apply until the 2007 limitation year, the room for abuse is small and surely outweighed by the harm in permitting the uncertainty associated with the use of the May 31, 2005, date.
